Results shown are actual past recoveries obtained by Winters & Yonker, P.A. and are objectively verifiable. Prior results do not guarantee a similar outcome. The prospective client may not obtain the same or similar results. Each case turns on its own facts, injuries, liability and available insurance coverage. Amounts are gross recoveries before attorneys' fees and costs.

Practice areas

We handle injury claims.
Nothing else.

No real estate closings, no divorces, no wills. One kind of law, every day, in the same Tampa Bay courthouses.

What a Florida claim actually covers

Beyond emergency care and follow-up treatment, a claim can include future medical costs, lost wages and lost earning capacity, out-of-pocket expenses, vehicle damage, and non-economic damages for pain, disability, disfigurement and loss of enjoyment of life. A spouse may hold a separate claim for loss of consortium.

Those categories are easy to leave money in when nobody itemizes them, which is exactly why a first offer arrives so fast.

And if you don't have a case, we'll say so

You will talk to a lawyer about which of those apply to you, not a case manager working from a script. If the honest answer is that your case is small, or that you don’t need a lawyer at all, we will tell you that on the first call.

Talk to a lawyer

Florida deadlines

Three clocks started
the day you were hurt.

Two of them started without anyone telling you. The honest answer to "when should I call a lawyer" is: before you speak to the other driver's insurance company.

14 Days To protect your PIP benefits Florida's no-fault law requires you to receive initial medical care within 14 days of a crash. Miss that window and your Personal Injury Protection coverage (up to $10,000 with an emergency medical condition diagnosis, $2,500 without) can be denied outright, leaving you personally responsible for the bills.
2 Years To file a negligence lawsuit House Bill 837 cut Florida's negligence deadline from four years to two, effective March 24, 2023. Claims arising on or after that date now expire in two years; wrongful death is two years from the date of death. Claims involving a government entity carry their own, shorter notice requirements.
Day One Before the evidence is gone Skid marks wash away in the first Tampa thunderstorm. Vehicles get repaired or sold for salvage. Commercial trucking logs and business surveillance footage are routinely overwritten within weeks. A preservation letter sent early is often the whole difference between proving fault and arguing about it.

The call you shouldn't take

Adjusters ask for a recorded statement early, while you are medicated and before anyone knows whether that shoulder needs surgery. Nothing in Florida law requires you to give one to the other driver's carrier. Once you are a client here, those calls come to us instead of you.

If someone told you it was your fault

Under the modified comparative negligence standard adopted in 2023, a person found more than 50% at fault recovers nothing. That is precisely why insurers now push blame onto injured people harder than they used to. Being told the wreck was your fault is a reason to call, not a reason not to.

This section describes Florida law in general terms as of 2026 and is not legal advice. Deadlines, exceptions and how they apply depend on the facts of your case. Confirm yours with an attorney before relying on any date above.

Common questions

It's our job
to provide clarity.

Winters & Yonker attorneys

"If the honest answer is that your case is small, or that you don't need a lawyer at all, we will tell you that on the first call."

Winters & Yonker · What happens when you ring
How much does it cost to hire you?

Nothing up front. We work on a contingency fee, which means our fee comes out of the recovery and there is no fee at all if we don’t recover money for you. Clients may still be responsible for case costs; we walk through exactly what that means, in writing, before you sign anything.

The insurance company already called me. Should I give a statement?

Not before you speak to a lawyer. Nothing in Florida law requires you to give a recorded statement to the other driver’s carrier, and those calls come early precisely because nobody yet knows how serious your injuries are. Once you are a client here, the adjuster calls us instead of you.

What if I was partly at fault?

You may still recover. Under Florida’s modified comparative negligence standard, adopted in 2023, your recovery is reduced by your share of fault, and only a person found more than 50% at fault recovers nothing. Insurers push blame onto injured people precisely because that threshold exists. Being told it was your fault is a reason to call, not a reason not to.

How long will my case take?

It depends on your treatment more than on the courts. Most cases resolve once doctors can say what your long-term prognosis is, because that is when the claim can be valued honestly. Straightforward claims can settle in months; cases involving surgery, disputed liability or a trial take longer. We will give you a realistic range on the first call and update it as the case moves.

Do I have to go to court?

Usually not. The large majority of injury claims settle without the client ever testifying. We prepare every case as though it will be tried, because that is what moves an insurer’s number, but the decision to accept an offer or go to trial is always yours, made with a clear picture of both.

Tampa Bay since 2001

Built to even out a fight
that starts uneven.

Winters & Yonker was founded by two Tampa trial lawyers, Bill Winters and Marc Yonker, who spent the early part of their careers watching insurance companies out-resource ordinary people. Within hours of a crash a carrier assigns an adjuster, an investigator and defense counsel. The injured person, meanwhile, is in an emergency room.

We represent people, never insurance companies: drivers and passengers hurt on I‑275 and I‑4, motorcyclists, pedestrians and cyclists, workers injured on Tampa construction sites, residents harmed in Bay-area nursing homes, and families of people killed by someone else’s negligence.

If you were hurt because somebody else was careless, you are who this firm was built for.

"The Aggressive Attorneys" has never described how we treat clients. It describes where the pressure gets pointed: at the carrier, and at the number the carrier has put on the table.

What's different

Hold any firm to this list.
Ours included.

Tampa Bay has no shortage of injury firms, and most promise the same things on the same billboards. The difference shows up later, in the unglamorous parts of a case.

"I called at 11 at night after my wreck, half expecting a machine. Someone answered and stayed on with me for twenty minutes. That was the moment I stopped panicking."

"The adjuster offered me $4,000 and said that was the policy limit. It wasn't. Winters & Yonker found two more policies I didn't know existed."
